PARENTAL NOTIFICATION OR CONSENT STATUTES
REGARDING ABORTION

A. Constitutional Law Addressing Parental Consent Or Notice Provisions.

1. A state statute without a judicial bypass procedure is unconstitutional. See Bellotti v. Baird, 443 U.S. 622 (1979).
2. A state statute requiring parental consent of two parents is unconstitutional even if it contains a judicial bypass provision. See Hodgson v. Minnesota, 497 U.S. 417 (1990).
3. A state statute requiring parental consent of one parent along with a judicial bypass provision is constitutional. See Planned Parenthood of Southeastern Pennsylvania v. Casey, 505 U.S. 833 (1992); Lucas v. South Carolina Coastal Council, 505 U.S. 1003 (1992); Ohio v. Akron Center for Reproductive Health, 497 U.S. 502 (1990); Planned Parenthood Ass’n of Kansas City, Missouri, Inc. v. Ashcroft, 462 U.S. 476 (1983); and H.L. Matheson, 450 U.S. 398 (1981).
4. A state statute requiring parental notification along with a judicial bypass procedure is constitutional. See Lambert v. Wicklund, 520 U.S. 292 (1997).
