Liberty Counsel Will File a Motion with the California Supreme Court Requesting a Stay and a Rehearing on the Marriage Decision

San Francisco, CA – Tomorrow, Liberty Counsel will file a motion with the California Supreme Court asking the Court to reconsider its ruling, which struck down the state marriage laws because of serious unintended consequences that the Court failed to address. Liberty Counsel’s filing will point out that the Court has unwittingly created a system that hopelessly entangles property, custody, visitation and other rights that will travel like a tsunami, wreaking havoc on couples in California and other states.

Liberty Counsel will also ask the Court to stay its opinion pending the outcome of a vote in November on a state constitutional amendment that will likely pass, overturn the Court’s ruling and preserve marriage as the union of one man and one woman.

Without the stay, the California Supreme Court opinion declaring a right to same-sex “marriage” will become final on June 14. Liberty Counsel, representing the Campaign for California Families, has been involved in defending the marriage laws from the beginning of the case in 2004.

Mathew D. Staver, Founder of Liberty Counsel and Dean of Liberty University School of Law, has argued the California marriage case at every stage of the litigation. Staver commented: "A number of unintended consequences will come from the same-sex marriage decision. It is imperative that the California Supreme Court reconsider the impact of its decision and stay the implementation of its opinion. It is unreasonable to turn marriage upside down in thirty days and then to expect that the myriad of laws and social institutions affected will fall into neat categories. This decision is a train wreck in the making, and the only prudent course requires the Court to push the pause button in implementing the decision."
