Washington, DC – Liberty Counsel filed an amicus brief with the United States Supreme Court in FCC v. Fox. The case involves a challenge by broadcast networks to the FCC decency standards for primetime television. Broadcasters claim that the standards are too “vague” and violate their First Amendment rights. In the brief, Liberty Counsel urges the Court to uphold the decency regulations. The brief is filed on behalf of Judith A. Reisman, Ph.D., an internationally recognized expert in media forensics and the effects of the work of Dr. Alfred Kinsey on society and the family.
Prime-time television has already degraded. Removing the current decency standards would allow prime-time TV to slide into a cinematic cesspool. The brief points out that the airwaves are owned by the people of the United States and that users of the airwaves, the broadcasters, have a duty to operate in the public interest. In the brief, Liberty Counsel cites social science and psychological studies, which demonstrate that even fleeting utterances of indecent words can adversely affect the developing brains of children and youth, which illustrates how critical it is that the decency standards remain in place.
