Washington, DC—Liberty Counsel is defending natural marriage as the union of one man and one woman in Texas and Indiana in two amicus briefs: one brief to the Fifth Circuit Court of Appeals in New Orleans and another brief to Seventh Circuit Court of Appeals in Chicago.  

 

When state legislatures in Texas, Indiana, and across the country memorialized marriage as the union of one man and one woman, they affirmed millennia of history and the natural created and observable order that marriage is a union of the two sexes that fosters stability, permanency, fidelity, and the very continuation of society. Marriage laws memorialize−but do not create−the definition of marriage. Marriage is defined by its nature and predates government, which is limited to regulating marriage in accordance with its natural, historical definition.

 

 Indiana’s and Texas’s marriage laws memorialize that marriage is and always has been the union of one man and one woman, a union that has inherent social good and which fosters equality between the sexes, optimal child-rearing, fidelity, and stability. These laws preserve and protect the health, safety, and welfare of all citizens. 

 

 “Natural marriage is not a political construct. It is neither liberal nor conservative. Natural marriage is part of the natural created order of men and women. Deconstructing the family into motherless or fatherless unions harms children. As a policy matter, same-sex ‘marriage’ says that children do not need fathers or mothers—that a male and female mom and dad are irrelevant. Such a policy statement hurts families, especially children. Children fare best when raised with a mom and a dad,” said Mat Staver, Founder and Chairman of Liberty Counsel.
