Iowa Voters Reject All State Supreme Court Justices Over Same-Sex Marriage

Yesterday Iowa voters supported marriage as between one man and one woman with a historic vote, where all three Supreme Court Justices lost their retention votes. Never before in the history of Iowa had any Supreme Court Justice not been retained. Of seven state Supreme Court Justices who overturned the people’s referendum to define marriage, three were up for a retention vote. Supreme Court Chief Justice Marsha Ternus and Associate Justices Michael Streit and David Baker all failed to retain the approval of the people of Iowa. More than 54 percent of voters rejected all three Justices.

Normally justices are retained without controversy, but because these justices legislated from the bench by inventing a so-called right to same-sex marriage, all three lost their jobs. Their decision was a gross overreach of their power, a misinterpretation of the Constitution, and a disregard for hundreds of years of precedent.

When the judges signed the same-sex marriage ruling directly opposing the voters and contrary to the constitutional text, they signed their own resignations. The justices crossed the line when they played the role of a legislator and abandoned judicial restraint. Liberty Counsel’s Mathew Staver published an Op Ed in the DesMoines Register, urging the people of Iowa to vote out these three Iowa Justices because of their judicial activism.
