Parent group SUED for reporting teacher’s vile public social media posts

Jacksonville, Florida, public school teacher Hope McMath was put on administrative leave after a series of vile social media posts, including one in which she mocked Charlie Kirk’s assassination. This woman teaches school children, whose parents were HORRIFIED by this teacher’s public post. The parents reported the post to Moms for Liberty, which passed the post on to the school board and the Florida Department of Education.

Now the teacher is SUING Moms for Liberty for reporting her vile public comments! That’s like someone breaking into your house, tripping over a rug, and then suing the homeowner.

Liberty Counsel is representing Jacksonville Moms for Liberty in a lawsuit brought by teacher Hope McMath. McMath publicly posted a shocking social media post celebrating Charlie Kirk’s assassination. Horrified parents saw the post and reported it to Moms for Liberty, which in turn passed the post on to the school board and state officials to investigate.

The day after Charlie Kirk’s assassination, McMath posted this on Facebook: “Karma’s a b*** - and she heard all your speeches. . .”

After investigating the post, the school board for the Florida Department of Education placed the teacher on administrative leave and removed her from the classroom.

Rather than apologizing for her vile post, McMath filed a lawsuit against Moms for Liberty for reporting her post to the proper authorities.

This is precisely the kind of case Florida’s Anti-SLAPP statute was enacted to prevent. Anti-SLAPP laws exist to stop lawsuits that use lawfare to punish or deter citizens from participating in public affairs or petitioning the government.

Liberty Counsel warned McMath to dismiss her lawsuit or she runs the risk of having to pay attorney's fees and costs. She refused. Liberty Counsel filed a motion to dismiss, asking the court to apply Florida’s Anti-SLAPP protections and to hold the plaintiff responsible for her frivolous lawsuit, including awarding attorney’s fees and costs against her.

The facts are straightforward:

  • The posts were public.
  • They were reported accurately.
  • Concerns were raised to appropriate authorities.
  • Authorities took appropriate action.

Citizens did not create the controversy, control the response, or impose discipline. Moms for Liberty exercised a legal right the Constitution explicitly protects.

If lawsuits like McMath’s are permitted to proceed, the impact extends far beyond this case. Parents, educators, and citizens everywhere may think twice before speaking up — even when concerns are legitimate and fully documented. Reporting bad behavior to proper authorities, as happened here, could subject a citizen to costly litigation.

Liberty Counsel stepped in because constitutional rights do not defend themselves, and because citizens should not need to fear legal retaliation simply for asking whether their children’s public school teachers and institutions are acting appropriately.
