American courts are using Sharia to decide cases

One of the most basic principles of U.S. law is that foreign laws do not apply in U.S. courtrooms. Even when a contract is executed in a foreign country, under that country’s laws, a U.S. court cannot uphold that contract or its tenets if they contradict U.S. law.

Sadly, some American judges apparently missed that question on their bar exam because judges right here in the U.S. have forced parties in U.S. courtrooms to abide by Sharia contracts and laws.

Congress MUST put a stop to the Islamic Sharia insanity infecting courtrooms across the nation.

What do all these cases have in common?

  • Odatalla v. Odatalla
  • Aziz v. Aziz
  • Ayad v. Latif
  • Chaudry v. Chaudry
  • S.D. v. M.J.R.

U.S. courts used Islamic Sharia to determine the cases. In the case of Odatalla v. Odatalla, a New Jersey court denied child support to the wife, even though at least one of the children was born in this country and therefore is a U.S. citizen because Pakistan’s Sharia divorces do not provide such support.

In the case of S.D. v. M.J.R., the judge refused to issue a restraining order protecting the wife — a documented victim of violent domestic abuse — even though the husband was being tried on criminal charges for the abuse. The judge said that under Sharia, husbands are allowed to treat their wives any way they like.

Granted, some of the aforementioned cases were, rightfully, overturned on appeal. But many were not. Either way, the fact remains that multiple American judges issued rulings based on Sharia, instead of American law.

And these aren’t the only cases. In many cases, Muslim men living in America forced their wives into binding arbitration — overseen by imams at a local mosque Sharia court — which U.S. courts uphold, especially in divorce cases.

Too often, these women are not aware of their rights under U.S. law, particularly in respect to spousal support, and therefore, lose their U.S. rights, thanks to the Sharia court’s “arbitration.”

The problem was becoming so bad in Oklahoma that the state legislature passed a law preventing Sooner State judges from applying Sharia in any court case. But the Tenth Circuit Court of Appeals voided that law, claiming it was based on racial/religious discrimination.

However, that argument does not hold weight because regardless of the race or religion which births any law, said law(s) MUST comport with U.S. law or they cannot be used in an American jurisprudence.

It’s time we lay down the law once and for all for these judges: NO LAW but U.S. LAW in America!

To do that, we need Congress to pass H.R. 5722 & S. 3009, the Preserving a Sharia-Free America Act.
