Islamic Sharia law creeping into the US legal system

Women right here in America are losing their rights, thanks to Islamic law implemented through Sharia tribunals acting as U.S. court-approved and often mandatory arbitration and dispute resolution practices — especially when it comes to divorce, domestic abuse, child custody, contracts, and financial settlements.

In 2021, a U.S. judge in Collin County, Texas, ruled that American citizen and Texas resident Mariam Ayad could only divorce her Texas-based Muslim husband in a Sharia-governed tribunal instead of proceeding through the Texas civil court system. The tribunal in question was a Texas-based “Fiqh” panel of Islamic judges governed by a group of Muslim clerics based in Saudi Arabia.
Under Sharia, women have no rights. A woman’s testimony does not count unless either one man or two other women corroborate her story.
Under Sharia-governed divorces, fathers get SOLE guardianship of the children (called wilayah), and the father gets to decide if the mother may ever see her own children. And while the father may choose to allow the mothers to have joint physical custody of children in their “tender Years,” Sharia courts automatically revoke a mother’s child custody rights when their children reach either 2 years or 7 years old, depending on the type of Sharia followed and if the child is a boy or a girl.
While the children are in their mother’s care, she is forbidden from raising her own children in any faith other than Islam, especially Christianity, or she will lose custody even earlier.
And even in cases of violent domestic abuse, Sharia generally requires the woman to stay with her abuser.
“America is facing an existential threat — the spread of Sharia Law,” says Rep. Roy.
“From Texas to every state in the union, instances of Sharia Law adherents have threatened the American way of life, seeking to replace our legal system and Constitution with an incompatible ideology that diminishes the rights of women, children, and individuals of different faiths,” Rep. Roy adds.
As America’s imported Muslim population continues to grow, so does Sharia’s influence on American jurisprudence.
Mariam had to fight all the way to the Texas Supreme Court to win back her rights as a Texan and an American. But Mariam should have never had to fight this battle in the first place.
Mariam isn’t Sharia’s only victim, and she won’t be the last, unless we get Congress to pass the “Preserving a Sharia-Free America Act” NOW!
