They Tried To Destroy Her, But Their Assault May Backfire  

For 10 long years, two men have used the Obergefell “marriage” opinion to harass Kim Davis, simply because she dared request her constitutionally guaranteed right to religious accommodation. Now they are trying to bankrupt her

Liberty Counsel is taking Kim’s case to the U.S. Supreme Court, asking the Court to stop Obergefell from being used to eliminate religious freedom.

This case isn’t just about Kim Davis. It affects ALL Christians under attack by the LGBTQ agenda. As I will reveal in Monday’s email, more than half of our current casework involves defending Christians from LGBTQ attacks using Obergefell as a weapon against believers. Kim Davis was simply Obergefell’s first victim.

She never wanted the spotlight. Yet, her name became known worldwide. Last week, her name resurfaced in news outlets from the U.S. to the U.K. and beyond. Kim Davis would have preferred to leave the controversy over “marriage” behind once she won her religious freedom rights in 2015.  

But two vindictive men have steadfastly refused to allow her to do so.  

For the last 10 years, David Ermold and David Moore have run a constant and targeted campaign of personal harassment against Kim solely because they want to punish her for her Christian faith.

When none of their histrionics and smear campaign managed to force Kim to violate her religious principles, they decided to try to RUIN Kim by suing her into bankruptcy.

I cannot overstate the importance of this case. After 10 long years of battling these two men, Liberty Counsel has brought the case to the U.S. Supreme Court, because if a person can be sued for exercising their First Amendment religious freedom rights, then America has no religious freedom at all.

A 10-year timeline of assault on Kim Davis...

In July 2015, David Ermold and David Moore could have received a marriage license from any number of Kentucky clerks. But they repeatedly traveled to Kim’s office to harass her because of her Christian faith.

The two men engineered a social media blitz to “shame” Kim. 

On July 17, 2015, the two Davids filed their first lawsuit against Kim, trying to force her to affix her name on their “marriage” certificate. The court later dismissed their lawsuit after Kentucky lawmakers approved changes to the marriage license form that removed the clerk’s name.

On September 4, 2015, the two Davids received their marriage certificate. But Kim’s name had been scratched out and replaced with a deputy clerk’s name. That wasn’t good enough for the two Davids, so they sued to try to force Kim to put HER name on THEIR certificate. The two Davids wound up losing again.

In December 2015, two months after they “married” (on Halloween of all days), the men continued their media campaign against Kim with a full-length feature in the internationally famous GQ magazine.

On December 6, 2017, Ermold tried to take Kim’s job as Rowan County clerk using the media (and another feature in GQ) to humiliate Kim.

When Ermold walked into the county office to file for the election, it was Kim who helped him navigate the paperwork and file the documents. If Kim were the bigot the pro-LGBTQ crowd makes her out to be, she would have refused to help Ermold, or had someone else do it for her. But Kim demonstrated pure grace to the man who had been, and was even at that very moment, attacking her.

Ermold lost the election.

But the two Davids weren’t done with Kim yet.

Ermold and Moore amended their suit against Kim, this time demanding she personally pay them 50,000 dollars each for “hurt feelings.” This is the case that is before the High Court today.

Ermond claimed Kim cost him his job. That was proven FALSE.

David Ermold claimed Kim Davis cost him his job. But Ermold’s former employer testified that Ermold’s claim was simply NOT TRUE.

So, mid-trial, the two Davids changed tactics again, this time claiming Kim should pay them because her religious beliefs “hurt their feelings.”

Can you imagine? These men have conducted a relentless campaign to harass, demean, and financially ruin Kim. And now they claim she hurt their feelings, by exercising her constitutionally guaranteed religious freedom!

The First Amendment bars awarding damages for “hurt feelings.” However, a jury awarded the two Davids 100,000 dollars without any evidence of damages. The total judgment now against Kim is 360,000 dollars — even though she obtained the religious accommodation she sought.

In the 10 years since the Obergefell opinion, U.S. Supreme Court Justices warned that the case would be used to bludgeon people of faith. Suffice it to say that for 10 long years, Obergefell has been used to turn Kim Davis into the LGBTQ’s punching bag. And for that reason alone, it must be overturned. I’ll share more details about that on Monday.
