The Fifth Circuit Court of Appeals recently issued an order to allow most Louisiana public schools to display the Ten Commandments as a legal challenge continues against five school districts.
Liberty Counsel has led the nation defending Ten Commandments displays since the early 2000s, and in 2005, I argued before the Supreme Court regarding the Ten Commandments in a historical display. Since then, we have never lost a case on a stand-alone or historical display of the Ten Commandments.
Two years ago, the Christian flag case I argued at the Supreme Court combined with the Coach Kennedy case overturned the 1971 case of Lemon v. Kurtzman that was used to infringe on religious liberty for decades. With the infamous “Lemon Test” now gone, it is now a new day for religious freedom in America!
The Ten Commandments and religious expression in the public square are now free of the tyranny of the so-called “Lemon Test.” And beginning in 2025, the Ten Commandments will be displayed in most Louisiana schools, thanks to the Fifth Circuit Court of Appeals’ recent order to allow the state to proceed with the state’s new law.
We celebrate that along with the Ten Commandments, the Declaration of Independence and the Pledge of Allegiance will soon be a reality for most public school students in Louisiana.
The Ten Commandments have profoundly influenced and shaped American law, government, and morality. There are about 50 displays of the Ten Commandments inside and outside the United States Supreme Court.
The Ten Commandments played a pivotal role in the foundation of American government and western legal tradition.
The Ten Commandments are the indisputable basis of our law and government and are clearly appropriate in public school classrooms and beyond. We are fighting to make this a reality.
The “Lemon Test” had been used by Courts since 1971 to interpret and censor religious viewpoints and remove religious displays from government property.
In our Shurtleff v. City of Boston, the Supreme Court unanimously ruled in our favor and rejected Boston’s use of the “Lemon Test” to censor religious viewpoints — namely a Christian flag on a public forum flagpole.
Citing our Shurtleff win in June 2022, the High Court in the Coach Kennedy case finally overruled Lemon v. Kurtzman, instructing that the First Amendment Establishment Clause must be interpreted by “reference to historical practices and understandings.”
The Justices wrote: “In fact, just this Term the Court unanimously rejected a city’s attempt to censor religious speech based on Lemon and the endorsement test (see Shurtleff, 596 U.S.)."
Because of the Shurtleff and Kennedy wins that overturned the “Lemon Test,” freedom of religion in the public square is being rightfully restored, and it’s legal to display the Ten Commandments once again.
Despite our victories, our hard-won achievements are being challenged by the ACLU and other anti-Christian entities. We need your help to keep religious freedom free.
