The Ninth Circuit Court of Appeals has sent mixed messages about whether undercover journalism is legal, ruling in favor of such journalism in Oregon while against it in California. People for the Ethical Treatment of Animals (PETA) just won a lawsuit overturning bans on undercover journalism that exposes animal abuse. The Supreme Court allowed this victory to stand.

But the woman who exposed the biggest child abuse case in history could be sent to prison, and she already faces a 16-million-dollar judgment in the Planned Parenthood civil case.

Sandra Merritt’s undercover videos exposed Planned Parenthood’s aborting babies for the sale of human body parts. But now, thanks to an aggressively pro-abortion California State attorney general who Planned Parenthood has financially supported since 1998, Sandra is the one facing years in prison if convicted and a 16-million-dollar judgment from her civil case.

Sandra Merritt’s undercover videos exposed abortionists and organ procurement staff openly admitting their regular breaking of federal laws regarding late term abortion, the sale of human body parts, and worst of all … the dissection of babies — some of which, one expert said, had to be ALIVE when their body parts were harvested!

Sandra’s videos capture the cavalier manner in which Planned Parenthood employees sorted through dissected baby parts in what looks like a common baking dish — proudly displaying intact arms, legs, lungs, and eyeballs of an 18-week-old twin the abortion mill had killed just hours before … all of which were for sale.

Facing up to 10 years in prison and 16 million dollars in civil fines, Sandra Merritt’s only hope has been her representation by Liberty Counsel. What Sandra did IS NOT a crime. In fact, Sandra Merritt is the first undercover journalist in all of California’s history to be prosecuted for being an undercover journalist.

Not one of the 40 Planned Parenthood officials Sandra’s work exposed has been charged with a crime.

Undercover journalism OK for animal abuse, but not child abuse?

The U.S. Supreme Court just allowed a lower court ruling, overturning the so-called “Ag Gag” rule. Undercover journalists at PETA had sued, rightly claiming that the agriculture industry’s push to stop undercover journalists from exposing animal abuse violated the First Amendment.

Yet what Sandra exposed about Planned Parenthood, complete with photos of dissected children, is outright child abuse of the most heinous kind.

In addition, there is now a conflict within the Ninth Circuit Court of Appeals. Recently, the Ninth Circuit Court ruled in favor of James O’Keefe’s political undercover recording and struck down a two-party consent law in Oregon.

However, the same Ninth Circuit with a different panel of judges ruled against our case defending Sandra Merritt’s undercover work in California. All of this begs the question, is undercover journalism only a crime when pro-lifers do it? Is exposing animal abuse protected by the First Amendment but not child abuse? This cannot stand!

We will not rest until justice is done. Liberty Counsel continues to defend Sandra against the 16-million-dollar judgment Planned Parenthood seeks in her civil trial.

The criminal trial against Sandra begins in less than two weeks, on November 3.
