UPS Orders Drivers Not to Pray Before Work

On January 16 and January 20, 2020, UPS management in Myrtle Beach, South Carolina, told drivers they "cannot pray anymore on company property." Since then, several drivers who regularly participated in prayer meetings have been fired for what appear to be pretextual reasons. Other drivers are afraid of speaking out in the wake of these firings.

On February 12, Liberty Counsel stepped in.

As you know, employees of private companies, including UPS, retain religious free exercise rights and may engage in religious expression while not on the clock, so long as it is voluntary and nondisruptive. Employees may voluntarily read the Bible, pray together, or discuss spiritual matters before their shifts begin for the day, during their lunch breaks, or during any other off-the-clock time when they may otherwise read or discuss secular topics.

The freedom to worship on one's own free time is a God-given, unalienable constitutional RIGHT that shall not be infringed.

In fact, any order that employees refrain from praying together under the circumstances is nothing less than religious discrimination as defined under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e–2(a).

Sadly, we live in a time when discrimination against Christians in America is becoming more and more prevalent. As a result, Liberty Counsel is being asked for help by more and more clients like these UPS drivers.
