Title VII was enacted, in part, to protect women in the workforce from discrimination, and does not include claims based on ‘sexual orientation” and “gender identity.” A plain reading of federal employment law is clear that it refers to biological male and female.

However, in the recent 6-3 opinion written by Justice Neil Gorsuch, the U.S. Supreme Court issued a lengthy opinion holding that, “An employer who fires an individual merely for being gay or transgender violates Title VII.” The implications of this opinion could be far reaching, particularly regarding ‘gender identity’ in sports and public accommodations.

However, the Supreme Court expressly stated that the First Amendment and the federal Religious Freedom Restoration Act will likely provide churches and religious organizations with a defense against the High Court’s application of Title VII.
