No Intervenors in Merritt’s Hearing

Jun 19, 2019

SAN FRANCISCO, CA – Sandra Merritt has asked the first district California Court of Appeal to prohibit Planned Parenthood’s operatives from participating in the preliminary hearing defending the 15 felony charges brought against her by Attorney General Xavier Becerra. The hearing is scheduled to begin on September 3, 2019.

The non-parties in this case are four of the fourteen “alleged victims” who appear in the undercover videos produced by the Center for Medical Progress, which expose Planned Parenthood’s outrageous conduct of harvesting and selling aborted baby body parts. The Superior Court previously permitted Merritt’s accusers to be named anonymously, under “Doe” pseudonyms, in the criminal complaint.

Liberty Counsel is defending Merritt against 15 felony charges brought against her by the attorney general in connection with her undercover journalism work which exposed Planned Parenthood’s trade in baby body parts. Merritt and Merritt’s co-defendant, David Daleiden, the founder of the Center for Medical Progress, are the first undercover journalists to be criminally prosecuted in the history of the state. Liberty Counsel has shown that, to date, no other citizen journalist or journalism organization has ever been charged with a crime for undercover recordings made in the public interest. Together, the weight of the evidence demonstrates that the prosecution against Merritt is selective and discriminatory.

“Allowing a private party to meddle in criminal proceedings supposedly brought by the state of California is unprecedented and unlawful,” said Horatio Mihet, Vice President of Legal Affairs and Chief Litigation Counsel for Liberty Counsel. “Planned Parenthood’s attempt to intervene in the Attorney General’s case pulls the mask off the unseemly collusion between them that is responsible for this political prosecution,” Mihet added.
